GESYNCED is a digital calendar and scheduling tool designed to help families, couples, and groups stay organized and in sync by sharing calendar events, to-dos, reminders, and communicating through secure in-app. By accessing or using our website, mobile application, or services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use our Services.
1. Acceptance of Terms
By using the Services, you confirm that you are at least 18 years old or have the legal capacity to enter into this agreement. If you are creating an account for a group or family, you represent that you have the authority to bind all members to these Terms. You agree to comply with these Terms and any applicable laws or regulations.
2. Description of Services
GESYNCED provides a digital platform for users to: Share calendar events, to-dos, and reminders with family, friends, or groups. Communicate via secure in-app notification. Organize routines, school events, appointments, and other activities. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without prior notice.
3. User Accounts
Registration: To access the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Group Accounts: If you create a group or family account, you are responsible for ensuring all members comply with these Terms. You may invite others to join your group, and they must also agree to these Terms. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account, including those of invited group members. Notify us immediately at hello@gesynced.com of any unauthorized use of your account. Account Termination: We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms or misuse of the Services.
4. User Responsibilities
Permitted Use: You agree to use the Services only for lawful purposes, such as organizing schedules, sharing events, or communicating with group members, in accordance with these Terms. Prohibited Conduct: You may not: Use the Services to send spam, offensive, or unlawful messages. Attempt to gain unauthorized access to our systems, networks, or other users' data. Share, upload, or transmit viruses, malware, or other harmful code. Reproduce, distribute, or modify any part of the Services without our prior written consent. Engage in any activity that disrupts or interferes with the performance of the Services.
5. Intellectual Property
Ownership: All content, trademarks, and intellectual property associated with the Services, including the GESYNCED platform, logos, and designs, are owned by GESYNCED or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal or group organizational purposes as intended. User Content: Any calendar events, to-dos, reminders, messages, or other content you create or upload through the Services ("User Content") remains your property. By uploading User Content, you grant GESYNCED a worldwide, non-exclusive, royalty-free license to use, store, display, and share such content as necessary to provide the Services, including sharing with other group members as directed by you. Feedback: Any feedback or suggestions you provide about the Services may be used by GESYNCED without obligation or compensation to you.
6. Payment and Subscriptions
Fees: Some features of the Services, such as premium scheduling tools or additional storage, may require payment. All fees are non-refundable unless otherwise stated. Details of paid features are available on our website or during the subscription process. Billing: If you subscribe to a paid plan, you authorize us to charge your provided payment method. You are responsible for ensuring your payment information is accurate and up-to-date. Price Changes: We reserve the right to modify subscription fees at any time. We will notify you of any changes at least 30 days in advance, and continued use of the Services constitutes acceptance of the new fees.
7. Privacy and Data Security
Data Sharing: By adding members to your group or sharing calendar events, you consent to sharing your User Content with those members. GESYNCED is not responsible for how group members use shared content. 8. Termination
By You: You may terminate your account at any time by following the instructions in the Services. Upon termination, your User Content may no longer be accessible to group members. By Us: We may terminate or suspend your access to the Services at our discretion, including for non-payment, violation of these Terms, or if we discontinue the Services. Effect of Termination: Upon termination, your right to use the Services will cease, and we may delete your account and User Content without liability, subject to applicable data retention policies.
9. Limitation of Liability
To the fullest extent permitted by law, GESYNCED and its affiliates, officers, directors, employees, or agents will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Services, including loss of data, missed appointments, or unauthorized access to your User Content. Our total liability for any claim will not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, secure, error-free, or that calendar events or reminders will be delivered without delay.
11. Indemnification
You agree to indemnify and hold harmless GESYNCED and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or in connection with these Terms, including their validity, breach, or termination, shall first be resolved amicably through direct negotiation between the parties. If no agreement can be reached within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Nicosia, Cyprus. 13. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on our website, within the app, or via email. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
14. Miscellaneous
Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and GESYNCED regarding the Services. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms at our discretion. No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
